The website www.harpers-legal.mc (the “Site”) is published by AML MONACO ADVISORY, a limited liability company with a share capital of EUR 30.200, whose registered office is located at Gildo Pastor Center, A, 7 rue du Gabian, 98000 Monaco, registered with the Monaco Trade and Industry Registry under number 16S07174, trading under the name “Harpers Legal”, hereinafter referred to as the “Firm”. The Publication Director is Mr Patricio Gimenez, Managing Partner. The contact details (email and telephone number) are provided at the bottom of this page.

The Site is hosted by Monaco Telecom SAM, a Monegasque public limited company with share capital of EUR 1,687,640, registered with the Monaco Trade and Industry Registry under number 97 S 03277, whose registered office is located at 4-6 avenue Albert II, 98000 Monaco.

Communication and Marketing consultants Eliott & Markus have designed and developed the website.

Liability

The Firm undertakes to use its best efforts to ensure that users can access the Site under normal operating conditions. However, the Firm shall not be liable for any temporary unavailability, for any reason.

Users of the Site acknowledge that they have read these terms of use and undertake to comply with them.

Users acknowledge that they have the necessary skills and resources to access and use the Site, and that they have checked that the IT configuration they use is free from viruses and in perfect working order. In particular, users undertake to access the Site using up-to-date hardware, and a latest-generation browser.

The Firm makes every effort to provide users with available and verified information and tools, but may not be held liable for errors, for the unavailability of information and/or for the presence of viruses, malware or other malicious software on its Site.

More generally, the Firm cannot guarantee the accuracy or completeness of the information published on its Site, nor the uninterrupted operation or full IT security of the Site. The information provided by the Firm is for indicative purposes and general information only. Users are invited to contact the Firm or any appropriate professional adviser in order to obtain advice tailored to their own situation. Users are required to comply with the provisions of Law No. 1.565 of 3 December 2024 on the protection of personal data, as well as any legislative or regulatory text that may amend it, and acknowledge that they use the information and tools available on the Site under their sole responsibility.

In particular, users must refrain from any collection, misuse and, more generally, any act likely to infringe copyright or intellectual property rights.

Under no circumstances may the Firm be held liable for any loss or damage arising from the use of the Site.

Protection of personal data

The terms governing the processing of personal data are set out in the personal data protection policy available on the Site.

Intellectual property

The Site as a whole, as well as each of its individual components, including specific programs and developments and content comprising data, text, still or animated images, logos, sounds, graphics and files, constitute works protected by intellectual property rights as Law No. 491 of 24 November 1948 on the protection of literary and artistic works, as amended. These elements are the exclusive property of the Firm or of third parties who have granted it a licence. Any total or partial representation of the Site or of any of its components without the Firm’s express authorization is prohibited and may constitute copyright infringement, which may give rise to civil proceedings for compensation for the damage suffered on the basis of Article 29 of Law No. 491 of 24 November 1948 and, where the acts are committed in bad faith, to the offence of infringement punishable under Articles 21 et seq. of said law.

The databases appearing on the Site are protected by Law No. 491 of 24 November 1948, as amended. Any qualitatively or quantitatively substantial extraction or reuse of the content of the databases without prior authorisation is prohibited and shall incur the civil and criminal liability of its author in accordance with the aforementioned provisions.

The trademarks and logos appearing on the Site are protected by Law No. 1.058 of 10 June 1983 on manufacturing, trade or service marks. They are registered by the Firm or by third parties that have authorised their use.

Any reproduction, imitation or use, in whole or in part, of these distinctive signs without the express authorisation of their owner, in breach of the prohibitions provided for by said law, may constitute trademark infringement and incur the liability of its author, in accordance with Articles 24 and 25 of Law No. 1.058 of 10 June 1983.

Other distinctive signs reproduced on the Site, including company names, trade names, business names and domain names, are the property of the Firm or of third parties. Any reproduction without express authorisation may constitute an act of unfair competition incurring the liability of its author on the basis of Article 1229 of the Monegasque Civil Code.

Links

The Firm reserves the right to modify or remove, at any time and without prior notice, the hyperlinks appearing on the Site to third-party websites. The existence of a link to an external website may not be interpreted as approval of its content by the Firm, which accepts no liability for the information, content or services offered by such websites.

Any creation of a hyperlink to the Site, whether simple or deep, is subject to the Firm’s prior written authorisation. This authorisation may be withdrawn at any time. Any integration technique, including framing, that consists of displaying the pages of the Site within a frame belonging to a third-party website is expressly prohibited.

Applicable law

Any dispute relating to the Site or its use shall be governed by Monegasque law. Exclusive jurisdiction is granted to the Monegasque courts, in particular the Court of First Instance of Monaco, without prejudice to the mandatory rules of jurisdiction applicable in consumer protection matters.

If any provision of these terms of use is declared null and void, unlawful or unenforceable by a competent court, that provision shall be deemed severable. The remaining provisions shall remain in force and retain their full effect. In such circumstances, the parties undertake to replace the invalidated provision with a lawful provision that comes as close as possible to the original intention.
